Welcome to https://aerohvacsolutions.ca (the “Website”). These Terms of Use (the “Terms”) are an agreement between you and Aero HVAC Solutions (the “Company”, “we”, “us”, or “our”). These Terms govern your access to and use of the Website and the information, features, and online services available through it (collectively, the “Website Services”).

These Terms govern use of the Website. Any HVAC inspection, estimate, installation, maintenance, repair, equipment purchase, warranty, or other service provided by the Company may be subject to a separate written estimate, work order, service agreement, financing agreement, or manufacturer’s terms. If there is a conflict concerning those services, the applicable written service agreement will govern, subject to applicable law.

Acceptance of These Terms

Please review these Terms carefully. By accessing or using the Website Services, you agree to be bound by these Terms. If you do not agree, you must not use the Website Services.

You must be at least 18 years old and legally capable of entering into an agreement to submit a request for an estimate or service. If you use the Website on behalf of an organization, you represent that you have authority to bind that organization.

Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Material changes will apply from the date they become effective. Your continued use of the Website after that date means you accept the revised Terms.

Website Access and Availability

We may update, change, suspend, or discontinue any part of the Website Services at any time. We do not guarantee that the Website or any feature will always be available, uninterrupted, secure, or error-free.

We may restrict or terminate access to the Website if we reasonably believe a user has violated these Terms, interfered with the Website, or created a security or legal risk.

Estimate, Appointment, and Service Requests

Submitting a form, requesting an estimate, or selecting an appointment time through the Website does not create a service contract or guarantee an appointment, price, equipment availability, installation date, or acceptance of the requested work. An appointment is confirmed only when the Company confirms it.

Website descriptions, promotions, and price indications are general information unless expressly stated otherwise. Final pricing and scope may depend on an inspection, measurements, equipment selection and availability, permits, taxes, site conditions, and other relevant factors. A written estimate, work order, or service agreement provided or accepted by the Company will govern the final scope, price, payment terms, warranties, and cancellation rights.

We may correct typographical errors, inaccurate descriptions, or obvious pricing errors on the Website. Nothing in these Terms limits rights that cannot legally be waived under Ontario’s Consumer Protection Act, 2002 or other applicable consumer-protection laws.

The Website is not an emergency dispatch service. A Website request should not be considered accepted until it is confirmed by the Company. In an emergency involving fire, suspected gas or carbon-monoxide exposure, or immediate danger, leave the affected area and contact 911 or the appropriate emergency or utility service.

You may use the Website Services only for lawful personal or business purposes and in accordance with these Terms.

violate any applicable law or another person’s rights;

Information about equipment performance, energy savings, operating costs, rebates, incentives, financing, warranties, or eligibility may depend on third-party rules and individual circumstances. Unless expressly confirmed in a written agreement, we do not guarantee that a particular product, rebate, saving, incentive, financing option, or result will be available or suitable for you.

The Website may contain links to or integrations with third-party websites, manufacturers, financing providers, review platforms, maps, payment processors, or other services. These third parties operate independently and are responsible for their own content, terms, privacy practices, and services. Limitation of Liability

To the fullest extent permitted by law, the Company and its officers, employees, agents, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential loss arising solely from your use of, or inability to use, the Website Services.

Nothing in these Terms limits liability for fraud, wilful misconduct, gross negligence, personal injury, property damage caused by our work, breach of an applicable written service agreement, or any liability or consumer right that cannot legally be limited or excluded. Any liability relating to HVAC equipment or services will be governed by the applicable written agreement and applicable law.

Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law principles. Subject to any rights you may have under applicable consumer-protection law, disputes concerning these Terms or the Website Services will be submitted to the courts of Ontario.

Miscellaneous

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver of that provision. These Terms and the documents referenced in them constitute the agreement between you and the Company concerning use of the Website Services.

You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms as part of a merger, reorganization, sale of the business, or transfer of the Website, subject to applicable law.
